2. Website information
The content on our website is provided for general business information only. It does not create a binding offer, contract, or professional relationship unless we separately agree to provide services to you through a written agreement, proposal, accepted order, invoice, platform subscription, or other confirmed arrangement.
We may update, change, remove, or replace website content at any time.
3. Services, plans, and separate agreements
Specific services, deliverables, pricing, billing terms, timelines, access rights, and service scope may be described in a separate proposal, order form, invoice, subscription plan, statement of work, or written agreement.
If there is a conflict between these Terms and a separate written agreement with you, the separate written agreement will apply to the extent of that conflict.
4. Free trials and platform access
We may offer free trials, demos, beta access, or limited platform access at our discretion.
Trial or beta access may be limited by time, usage volume, number of prompts, number of AI models, number of reports, or other restrictions. We may modify, suspend, or end trial access at any time.

5. Client materials and user inputs
To provide our services, we may ask you to provide materials such as website URLs, brand descriptions, competitor names, market segments, prompts, business information, content, positioning notes, or other relevant information.
You confirm that:
you have the right to provide these materials to us;
the materials are accurate to the best of your knowledge;
the materials do not violate any law or third-party rights;
you will not submit sensitive, confidential, unlawful, or personal data unless necessary and authorized.
You remain responsible for the materials and information you provide.
6. AI-generated outputs and analytics
Our services may rely on AI models, third-party APIs, search outputs, publicly available sources, model responses, and automated or semi-automated analysis.
AI systems are probabilistic and may produce outputs that are incomplete, inaccurate, inconsistent, outdated, or different across models, sessions, languages, locations, or time periods.
We do not guarantee that:
your brand will appear in AI-generated answers;
your brand will achieve a specific ranking, mention rate, score, citation rate, or visibility level;
AI models will interpret your brand in a specific way;
search engines, AI systems, or third-party platforms will index, cite, recommend, or display your brand;
any GEO, SEO, AEO, marketing, commercial, revenue, or business outcome will be achieved.
Our reports, scores, recommendations, and insights are analytical outputs intended to support business decision-making. They should not be treated as legal, financial, investment, or guaranteed performance advice.

violate any law or regulation;
infringe intellectual property, privacy, or other third-party rights;
submit unlawful, harmful, misleading, or unauthorized content;
attempt to gain unauthorized access to our systems;
interfere with website or platform functionality;
scrape, copy, reverse engineer, or misuse our platform, reports, data, or methodology;
use our services to generate spam, deception, malware, or harmful content;
submit confidential or personal data that you are not authorized to share.
We may suspend or terminate access if we believe these Terms have been violated.
8. Intellectual property
All content, branding, text, visuals, frameworks, templates, reports, scoring logic, dashboards, methodologies, platform features, software, and materials made available by us are owned by or licensed to AI, TELL ME!, unless stated otherwise.
You may not copy, reproduce, modify, distribute, resell, reverse engineer, or create derivative works from our website, platform, reports, or materials without our prior written permission.
Subject to payment and any applicable agreement, you may use reports and deliverables created specifically for you for your internal business purposes.
9. Your content and analysis data
You retain ownership of the content and materials you provide to us.
You grant us the right to use, process, analyze, store, and transmit those materials as reasonably necessary to provide the requested services, operate the platform, generate reports, improve service quality, maintain security, and comply with legal obligations.
Unless otherwise agreed, we may use aggregated or anonymized data for internal analysis, product improvement, benchmarking, and service development, provided it does not directly identify you or your confidential business information.
10. Third-party services
Our website and services may use or integrate with third-party providers, including website platforms, cloud infrastructure, analytics tools, payment providers, AI model providers, APIs, communication tools, and other services.
We are not responsible for the availability, accuracy, performance, policies, or actions of third-party services.
Your use of third-party services may be subject to their own terms and privacy policies.
11. Fees, billing, and taxes
Fees, billing periods, payment methods, included usage, add-ons, taxes, and renewal terms will be set out in the applicable plan, invoice, proposal, or agreement.
Unless otherwise stated, fees are exclusive of applicable taxes.
Failure to pay amounts due may result in suspension or termination of services.
12. Cancellations and refunds
Cancellation, renewal, and refund terms depend on the specific plan, subscription, proposal, or agreement applicable to your purchase.
Unless a separate written agreement states otherwise, fees already paid for completed work, delivered reports, used platform access, or started service periods are non-refundable to the maximum extent permitted by law.

We aim to keep our website and services available, but we do not guarantee uninterrupted, secure, or error-free access.
We may modify, suspend, restrict, or discontinue any part of the website, platform, or services at any time, including for maintenance, security, technical, legal, or business reasons.
14. Confidentiality
If either party receives non-public business, technical, commercial, or strategic information from the other party in connection with the services, the receiving party should use reasonable care to protect that information and use it only for the purpose of the relationship.
Confidentiality obligations do not apply to information that is publicly available, already known lawfully, independently developed, received from a third party without restriction, or required to be disclosed by law.
15. Limitation of liability
To the maximum extent permitted by law, AI, TELL ME! will not be liable for indirect, incidental, special, consequential, punitive, or business losses, including loss of profits, revenue, data, goodwill, opportunities, or expected savings.
To the maximum extent permitted by law, our total liability for any claim related to the website, platform, or services will not exceed the amount paid by you to us for the relevant services during the three months before the event giving rise to the claim.
Nothing in these Terms limits liability where it cannot legally be limited.
16. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, platform, or services, your violation of these Terms, or materials you provide that infringe third-party rights or violate applicable law.
17. Privacy
Our processing of personal data is described in our Privacy Policy. By using the website or services, you acknowledge that personal data may be processed as described there.
